Memory Gold (“Memory Gold,” “Company,” “we,” “us,” or “our”) respects the privacy of the people who use and participate in our Services. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you access or use our website, software, applications, AI-assisted interviewing tools, transcription, translation, memoir generation, digital preservation, and related products and services.

Memory Gold is designed around a fixed two-role project structure. Each project includes one Buyer role and one Storyteller role. The Buyer and Storyteller may be the same person or two different people.

Because our Services involve deeply personal memories, audio recordings, photographs, family histories, translations, and biographical narratives, we take privacy seriously.

By using the Services, you agree to this Privacy Policy.

1. Key Definitions

1.1 Buyer

The Buyer is the person who purchases, pays for, initiates, and manages a Memory Gold project. The Buyer may purchase the Services for themselves or for another person.

1.2 Storyteller

The Storyteller is the person whose memories, voice, likeness, photographs, language, family history, and personal stories are collected or processed to create the final Memory Gold deliverable.

When the Buyer purchases Memory Gold for themselves, the Buyer is also the Storyteller.

When the Buyer purchases Memory Gold for another person, the Buyer and Storyteller are different individuals, and separate Storyteller consent is required before recording, transcription, translation, AI processing, or memoir generation begins.

1.3 Personal Information

"Personal Information" means information that identifies, relates to, describes, could reasonably be associated with, or could reasonably be linked to an individual.

1.4 User Content

"User Content" includes audio recordings, video recordings, written responses, interview answers, transcripts, translations, photographs, names, dates, locations, family documents, memoir drafts, final deliverables, and other content submitted to or generated through the Services.

2. Information We Collect

We may collect the following categories of information.

2.1 Buyer Account Information

We may collect:

  • name;
  • email address;
  • phone number;
  • billing address;
  • account login information;
  • project details;
  • whether the Buyer is purchasing for themselves or for another person;
  • relationship to the Storyteller, if different from the Buyer;
  • customer support communications;
  • purchase history;
  • subscription status; and
  • account preferences.

2.2 Storyteller Information

We may collect:

  • name;
  • email address or phone number;
  • preferred language;
  • consent records;
  • voice recordings;
  • video recordings, if enabled;
  • interview responses;
  • transcriptions;
  • translations;
  • biographical details;
  • family history;
  • photographs;
  • likeness;
  • dates and locations mentioned in stories;
  • memories about family members or third parties; and
  • edits, approvals, or comments.

When the Buyer is also the Storyteller, Buyer information and Storyteller information may relate to the same individual.

2.3 Payment Information

Payments may be processed by third-party payment processors. We may receive limited payment-related information, such as:

  • transaction ID;
  • payment status;
  • last four digits of a payment card;
  • billing ZIP code;
  • invoice history;
  • refund status; and
  • subscription plan.

We do not intend to store full payment card numbers on our own systems.

2.4 AI, Transcription, and Translation Data

To provide the Services, we may process:

  • audio files;
  • voice data;
  • speech-to-text transcripts;
  • translated text;
  • prompts and responses;
  • memoir drafts;
  • summaries;
  • structured timelines;
  • edited narrative outputs; and
  • quality review information.

2.5 Technical and Usage Information

We may automatically collect:

  • IP address;
  • device identifiers;
  • browser type;
  • operating system;
  • pages viewed;
  • referring URLs;
  • interaction logs;
  • error logs;
  • session information;
  • approximate location derived from IP address;
  • cookie identifiers; and
  • analytics events.

2.6 Communications

If you contact us, we may collect:

  • email messages;
  • chat messages;
  • support tickets;
  • feedback;
  • survey responses;
  • call notes; and
  • other communications.

2.7 Free Sample Call Information

If you schedule or participate in a Free Sample Call, we may collect:

  • the scheduler's name and contact information;
  • the Storyteller's name and phone number;
  • preferred language;
  • call date and time;
  • consent records;
  • call recordings;
  • call transcripts;
  • translations;
  • sample story outputs;
  • call metadata; and
  • related communications or follow-up information.

No payment information is required for a Free Sample Call.

Storyteller consent for the Free Sample Call is obtained verbally at the beginning of each call. Before any recording begins, the automated call system notifies the Storyteller that the call will be recorded, explains how their responses will be used, and requires an affirmative response - either saying "I agree" or pressing 1 - before recording starts. A Storyteller who does not provide affirmative consent may decline by hanging up. Recording begins only after affirmative consent is confirmed.

3. How We Collect Information

We collect information:

  • directly from the Buyer;
  • directly from the Storyteller;
  • from the same person when the Buyer is also the Storyteller;
  • through interviews, recordings, uploads, forms, and account setup;
  • through AI-assisted processing;
  • through service providers;
  • through cookies and similar technologies;
  • through customer support interactions; and
  • through payment processors and fulfillment partners.

4. How We Use Information

We use personal information to:

  • create and manage accounts;
  • determine whether the Buyer is also the Storyteller or whether the Buyer is purchasing for another person;
  • verify Buyer and Storyteller consent;
  • provide the Services;
  • conduct interviews;
  • record Storyteller responses;
  • transcribe audio;
  • translate speech or text;
  • organize memories;
  • generate memoir drafts;
  • create final digital deliverables;
  • provide customer support;
  • process payments;
  • schedule and conduct the Free Sample Call;
  • obtain and document Storyteller consent;
  • record the call with consent;
  • transcribe, translate, organize, and prepare the Storyteller's responses;
  • create a sample Memory Gold story or preview;
  • demonstrate the Services;
  • follow up about whether the Buyer or Storyteller wishes to purchase a paid plan;
  • respond to questions or support requests;
  • maintain security and prevent misuse;
  • comply with law;
  • improve the Services;
  • manage subscriptions;
  • send service-related communications;
  • troubleshoot technical issues;
  • improve user experience;
  • maintain security;
  • detect fraud or misuse;
  • enforce our Terms;
  • comply with law;
  • respond to legal requests;
  • protect rights, safety, and property; and
  • perform other purposes disclosed at the time of collection.

5. AI Processing

Memory Gold uses AI tools to support interviewing, transcription, translation, organization, editing, and narrative generation.

5.1 What AI May Do

AI tools may:

  • suggest interview questions;
  • transcribe audio recordings;
  • translate responses between languages;
  • summarize responses;
  • identify chronology and themes;
  • draft narrative passages;
  • improve readability;
  • format content into chapters or sections; and
  • assist with editing and organization.

5.2 Human Review

AI outputs may be inaccurate, incomplete, biased, or mistranslated. Buyers and Storytellers should review and verify AI-generated outputs before relying on, publishing, printing, or sharing them.

When the Buyer is also the Storyteller, that person should review and verify AI-generated outputs.

5.3 No Training of Public Foundation Models Without Consent

Memory Gold does not knowingly permit User Content, Storyteller recordings, family histories, photographs, transcripts, or memoir drafts to be used to train public foundation AI models unless we obtain separate express consent.

5.4 Third-Party AI Providers

We may use third-party AI, transcription, translation, hosting, and infrastructure providers to process User Content. These providers process information on our behalf for the purpose of providing the Services.

6. Legal Bases for Processing

Where required by law, we rely on one or more legal bases to process personal information, including:

  • consent;
  • performance of a contract;
  • legitimate interests;
  • compliance with legal obligations;
  • protection of vital interests; and
  • establishment, exercise, or defense of legal claims.

For Storyteller recordings, voice data, translation, transcription, and AI processing, we rely primarily on Storyteller consent and the need to provide the requested Services.

When the Buyer is also the Storyteller, the Buyer's acceptance of the Services and Storyteller consent may be collected in the same onboarding flow, but the consent categories should remain separately identified.

7. How We Share Information

We do not sell your family stories, recordings, photographs, or memoir content.

We may share information in the following circumstances.

7.1 Between Buyer and Storyteller

When the Buyer and Storyteller are different people, project content may be visible to both roles, depending on product settings and workflow.

The Storyteller should understand that their answers, recordings, transcripts, translations, drafts, photographs, and final memoir may be shared with the Buyer.

When the Buyer is also the Storyteller, project content is associated with that single user account unless the user chooses to share it or unless sharing is required to provide the Services.

7.2 Service Providers

We may share information with vendors that help us provide the Services, including:

  • cloud hosting providers;
  • database providers;
  • AI model providers;
  • speech-to-text providers;
  • translation providers;
  • payment processors;
  • email providers;
  • analytics providers;
  • customer support tools;
  • security tools;
  • file storage providers;
  • print fulfillment partners, if applicable; and
  • professional advisors.

These providers are authorized to process information only as needed to provide services to us or as otherwise permitted by law.

7.3 Legal Compliance and Protection

We may disclose information if we believe disclosure is necessary to:

  • comply with law;
  • respond to subpoenas, court orders, or legal process;
  • enforce our Terms;
  • protect our rights, users, employees, or others;
  • investigate fraud, abuse, or security issues;
  • prevent harm; or
  • respond to lawful government requests.

7.4 Business Transfers

If Memory Gold is involved in a merger, acquisition, financing, restructuring, bankruptcy, sale of assets, or similar transaction, personal information may be transferred as part of that transaction, subject to appropriate protections.

7.5 With Consent

We may share information for other purposes with your consent.

8. No Sale or Advertising Monetization of Family Content

Memory Gold will not sell, rent, or monetize User Content, Storyteller recordings, transcripts, translations, family histories, photographs, or final memoirs to advertisers, data brokers, or unrelated third parties.

We do not use deeply personal family history content for behavioral advertising.

If our practices change, we will update this Privacy Policy and obtain consent where required by law.

9. Cookies and Analytics

We may use cookies, pixels, SDKs, local storage, and similar technologies to:

  • keep users logged in;
  • remember preferences;
  • improve site performance;
  • understand usage;
  • troubleshoot errors;
  • prevent fraud;
  • measure marketing effectiveness; and
  • improve the Services.

You may be able to control cookies through your browser settings. Some features may not work properly if cookies are disabled.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including:

  • encryption in transit;
  • encryption at rest where appropriate;
  • access controls;
  • authentication;
  • least-privilege access;
  • vendor review;
  • monitoring;
  • backups;
  • logging; and
  • internal privacy and security practices.

No system is completely secure. We cannot guarantee that information will never be accessed, disclosed, altered, or destroyed by unauthorized persons.

11. Data Retention

We retain personal information for as long as reasonably necessary to:

  • provide the Services;
  • maintain project access;
  • create and preserve deliverables;
  • provide support;
  • comply with legal obligations;
  • resolve disputes;
  • enforce agreements;
  • maintain backups;
  • prevent fraud or abuse; and
  • fulfill the purposes described in this Privacy Policy.

For completed projects, Memory Gold retains audio recordings, transcripts, translations, and associated memoir content for as long as the Buyer's account remains active, in order to support QR code audio playback access. If a Buyer closes their account, Memory Gold may retain completed project materials for an additional period of 12 months before deletion, unless a longer period is required or permitted by law.

If an account lapses or is terminated before a project is completed, we may retain project data for a grace period of 90 days before deletion or restriction of access, unless a longer period is required or permitted by law.

If you participate in a Free Sample Call but do not purchase a paid plan, Memory Gold may retain the Free Sample Call recording, transcript, sample story, consent record, and related information for up to 90 days after the call, unless you request deletion sooner or unless a longer retention period is required or permitted by law.

After that period, Memory Gold may delete or de-identify the Free Sample Call materials, subject to legal, security, backup, fraud-prevention, dispute-resolution, and operational needs.

Backup copies may persist for a limited period after deletion from active systems.

12. Deletion and Withdrawal of Consent

The Buyer or Storyteller may request deletion of personal information by contacting us at privacy@memorygold.co.

Important Notice Regarding QR Code Audio Access: If a Storyteller requests deletion of their voice recordings, all QR codes associated with those recordings in any printed Memory Gold books will be permanently and immediately disabled. Audio playback through those QR codes will no longer be available. This action cannot be undone, and Memory Gold cannot restore access to deleted recordings. Buyers should be aware that printed books containing disabled QR codes cannot be exchanged or reprinted at Memory Gold's expense as a result of a Storyteller-initiated deletion request.

The Storyteller may withdraw consent for future processing. Withdrawal may prevent Memory Gold from continuing the project.

When the Buyer is also the Storyteller, that person may request deletion or withdraw Storyteller consent, subject to the limitations described in this Privacy Policy.

When the Buyer and Storyteller are different people, a Storyteller withdrawal request may require Memory Gold to pause or terminate the project, even if the Buyer wishes to continue.

Deletion or withdrawal requests may be limited where we need to retain information to:

  • complete a transaction requested before withdrawal;
  • comply with law;
  • prevent fraud or security incidents;
  • resolve disputes;
  • enforce agreements;
  • maintain business records;
  • protect legal rights;
  • complete backups on a reasonable schedule; or
  • comply with other legitimate legal obligations.

If a Storyteller withdraws consent before the final deliverable is completed, Memory Gold may pause or terminate the project. Refunds, if any, will be handled under the applicable refund policy.

13. Privacy Rights

Depending on where you live, you may have rights to:

  • access personal information;
  • correct inaccurate personal information;
  • delete personal information;
  • receive a copy of personal information;
  • restrict processing;
  • object to processing;
  • withdraw consent;
  • opt out of certain sharing or targeted advertising;
  • limit the use of sensitive personal information;
  • appeal a privacy decision; and
  • lodge a complaint with a data protection authority.

We may need to verify your identity before fulfilling a request.

14. California Privacy Notice

If you are a California resident, California law may provide additional rights.

14.1 Categories of Personal Information Collected

We may collect the following categories:

  • identifiers, such as name, email, phone number, IP address, and account ID;
  • commercial information, such as purchases and subscription status;
  • internet or network activity, such as pages viewed and usage logs;
  • audio, electronic, visual, or similar information, such as recordings and photographs;
  • geolocation information, such as approximate location from IP address;
  • professional or employment information if submitted in stories;
  • inferences created from submitted content to organize memoirs; and
  • sensitive personal information, such as voice recordings, family history, language, personal stories, and potentially information revealing racial or ethnic origin, health, religion, or other sensitive topics if voluntarily submitted.

14.2 Purposes

We collect and use these categories for the purposes described in this Privacy Policy, including providing the Services, processing payments, generating memoirs, security, support, and legal compliance.

14.3 Sale or Sharing

Memory Gold does not sell personal information. Memory Gold does not share personal information for cross-context behavioral advertising purposes.

We do not sell or share Storyteller voice recordings, family histories, memoir content, transcripts, translations, or photographs.

California residents have the right to opt out of the sale or sharing of their personal information. Because Memory Gold does not sell or share personal information for these purposes, no opt-out mechanism is currently required. If our practices change, we will update this Privacy Policy and provide the required opt-out mechanism before any sale or sharing begins.

California residents who believe their personal information has been sold or shared without authorization may contact us at privacy@memorygold.co.

Memory Gold does not knowingly sell or share personal information of children under 16.

14.4 Sensitive Personal Information

We use sensitive personal information only as reasonably necessary to provide the Services, ensure security, comply with law, or as otherwise permitted by applicable law.

14.5 California Rights

California residents may have the right to know, access, correct, delete, limit, and opt out of certain uses of personal information.

14.6 SMS Messaging Retention

Memory Gold retains records of SMS consent, including:

  • the date and method consent was obtained, such as a checked checkbox on 2/15/2026;
  • the phone number consented to; and
  • the specific categories of messages consented to.

These records are retained for the duration of the customer relationship plus 5 years to satisfy legal obligations under the Telephone Consumer Protection Act (TCPA) and similar state laws. This 5-year retention period aligns with the FTC's Telemarketing Sales Rule (TSR) and provides Memory Gold with proof of consent in the event of any inquiry or dispute.

Storyteller consent on behalf of the Buyer is documented as part of the advance notice process and is retained in the same manner.

15. International Data Transfers

Memory Gold may process information in the United States and other countries where we or our service providers operate.

If you are located outside the United States, your information may be transferred to jurisdictions that may not provide the same level of data protection as your home country.

Where required, we use appropriate safeguards for international transfers, such as contractual protections or other lawful mechanisms.

16. Children's Privacy

Memory Gold is intended for adult Buyers and adult Storytellers.

We do not knowingly collect personal information directly from children under 13 without legally required parental consent.

Family histories may incidentally include information about children or grandchildren submitted by an adult Buyer or Storyteller. The adult submitting such information is responsible for ensuring they have the right to do so.

If you believe we have collected personal information from a child under 13 without required consent, contact us at privacy@memorygold.co, and we will take appropriate steps.

17. Deceased Persons

Memory Gold may include stories, photographs, and information about deceased relatives. Privacy laws vary in how they treat information about deceased persons.

You are responsible for ensuring that submitted content does not violate applicable laws, family agreements, estate obligations, confidentiality duties, or rights of living individuals.

18. Accuracy of Transcription and Translation

Because Memory Gold may involve multilingual transcription and translation, errors may occur.

We use reasonable efforts to provide useful transcription and translation, but we do not guarantee perfect accuracy. Buyers and Storytellers should review outputs for accuracy, tone, meaning, names, dates, places, and cultural nuance.

When the Buyer is also the Storyteller, that person should review outputs for accuracy, tone, meaning, names, dates, places, and cultural nuance.

19. Voice, Likeness, and Media Release

Before recording or processing a Storyteller's voice, likeness, photograph, or video, Memory Gold requires Storyteller consent.

The Storyteller may consent to use of their voice, likeness, and submitted media solely for providing the Services and creating the requested deliverable.

When the Buyer is also the Storyteller, this consent may be collected during the same onboarding flow as Buyer checkout consent, but it should remain separately identified from billing consent.

Memory Gold will not use Storyteller voice, likeness, photographs, or memoir content in advertising, public examples, testimonials, training datasets, or promotional materials without separate express consent.

20. Marketing Communications

We may send service-related messages, such as account notices, consent requests, billing reminders, project updates, security alerts, and policy notices.

We may also send marketing emails where permitted by law. You may opt out of marketing emails by using the unsubscribe link or contacting us.

Even if you opt out of marketing emails, we may still send non-marketing service communications.

21. Do Not Track

Some browsers transmit "Do Not Track" signals. Our Services may not currently respond to all such signals. Where required by law, we will honor applicable opt-out preference signals.

22. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted with a revised "Last Updated" date.

If changes are material, we may provide additional notice, such as email notice or in-product notice.
